Terms & Conditions

By accessing the Fooyo website or using any Fooyo product, you agree to these Terms & Conditions. If you're accepting on behalf of an organisation, you confirm you have the authority to bind that organisation, and "you" refers to that organisation throughout.

Fooyo provides AI-powered products including an AI Knowledge Base, marketing AI (Kakis), commerce tooling, and Smart Tourism solutions, delivered via deployment in your own cloud or on-premise environment and supporting services. Specific product features, service levels and deployment terms are set out in your customer agreement or order form.

Certain Fooyo products require an account. You're responsible for keeping account credentials confidential and for all activity under your account. Notify us immediately of any unauthorised use.

You agree not to use Fooyo products for any unlawful purpose, attempt to reverse-engineer or extract our underlying models, upload content you don't have the rights to, or use the service in a way that could disrupt or overload our infrastructure. We may suspend access for use that violates this section.

Fooyo retains all rights, title and interest in the Fooyo platform, models and underlying technology. You retain ownership of the content and data you upload; you grant us a limited licence to process that data solely to provide the service to you.

Fees, billing cycles and payment terms are set out in your order form or customer agreement. Unless stated otherwise, fees are non-refundable and invoices are due within the period specified on the invoice.

Each party agrees to protect the other's confidential information with the same care it uses for its own confidential information, and not to disclose it except as needed to perform under these terms or as required by law.

Our collection and use of personal data is described in our Privacy Policy. Where Fooyo processes personal data on your behalf, the terms of our Data Processing Agreement, available on request, apply.

Fooyo products are provided "as is" without warranties beyond those expressly stated in your customer agreement. To the extent permitted by law, Fooyo is not liable for indirect, incidental or consequential damages, and our total liability is capped as set out in your customer agreement.

Either party may terminate as set out in the applicable customer agreement. On termination, your right to access the service ends, and we'll return or delete your data per the agreed retention terms.

These terms are governed by the laws of Singapore, and any disputes are subject to the exclusive jurisdiction of the Singapore courts, unless otherwise agreed in your customer agreement.

We may update these terms from time to time. Material changes will be reflected by an updated "Last updated" date above and, where appropriate, communicated directly to active customers.
